Plain-English summary: TopMark is an IGCSE study tool. Use it to learn, not to cheat. Our AI can be wrong — always double-check with your teacher or the official mark scheme. We try to keep things working, but we can't promise perfection. Don't share your account, don't try to break the site, and don't upload anything illegal. If you're under 13, get a parent's OK first.

1. Acceptance of these terms

By creating an account, signing in, or using TopMark (“the Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use the Service.

You are responsible for keeping your password secret and for everything that happens under your account. Tell us at topmarkigcse@gmail.com immediately if you suspect someone else is using it. One account per person. Do not share accounts.

5. AI features & accuracy

TopMark uses AI to mark answers, explain mark schemes, generate quizzes, and answer doubts. AI output can be wrong, incomplete, or out of date. It is provided as a study aid, not as an authoritative source. Always cross-check important answers against your textbook, your teacher, or the official Cambridge mark scheme. TopMark is not liable for results, grades, or decisions made on the basis of AI output.

Inputs you send to AI features (your typed questions, uploaded images, etc.) may be processed by third-party AI providers. Do not paste personal data, identifying information about other people, or anything confidential.

6. Content & intellectual property

Your content. You keep ownership of anything you type or upload. You grant TopMark a limited licence to store, display, and process it for the purpose of running the Service for you.

Our content. Past papers, mark schemes, and syllabus references are © Cambridge International Examinations. We display them for private study under fair-use educational principles. The TopMark site design, code, and original explanations are © TopMark. Do not copy or redistribute either without permission.

7. Subscription plans

TopMark offers three plans:

Subscriptions auto-renew monthly until you cancel. Daily AI prompt counts reset at 00:00 UTC. Prices are shown in USD and may change with 30 days' notice to existing subscribers.

Cancellation & refunds

You can cancel at any time from your Settings. When you cancel, your subscription stops renewing and your paid access continues until the end of the current billing period — you are not charged again after that.

Payments are non-refundable. We do not provide refunds for the current period, partial/unused time, or past periods, except where a refund is required by applicable law. By subscribing you acknowledge and accept this policy.

8. Privacy

We collect the minimum needed to run the Service: your email, display name, progress data, bookmarks, and the questions you submit to AI features. We do not sell your data. We use Supabase (auth + database) and AI providers to power the Service. Full details — what we collect, who we share it with, your rights, and how to delete your data — are in our Privacy Policy.

9. Termination

You may delete your account at any time by emailing us. We may suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service stops immediately.

10. Warranty disclaimer

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate.

11. Limitation of liability

To the maximum extent permitted by law, TopMark and its operators will not be liable for any indirect, incidental, consequential, or punitive damages, or for any loss of grades, opportunity, profits, data, or goodwill arising out of your use of (or inability to use) the Service. Our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose, or USD 50, whichever is greater.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be notified by email and by an in-app banner. The “Last updated” date at the top of this page shows the most recent revision. Continued use after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which TopMark's operator is based. Any dispute will be handled in the courts of that jurisdiction. Nothing in these Terms removes any consumer rights you have under the laws of your country that cannot be waived.
